MRC Rules on Round 5 Incidents With Aless And Nicoletti

OFFICIAL RULING FROM MRC HEAD REFEREE PAUL KINGSLEY 

Event: Pro 450 Class Moto 2, MX Tour Round Five, Sand Del Lee, Ottawa, Ontario

Date: July 20, 2019

At the completion of the 450 events in Ottawa, MRC Head Referee Paul Kingsley had placed the 450 results from moto 2 under official review for the purpose of interviewing parties involved, collecting eye-witness accounts and debriefing with officials to apply the rulebook for multiple infractions that transpired throughout the event.

Upon completion of this review the following penalties will be applied to individuals named below based on the rulebook, with the interpretation and discretion of the head referee.

#54 Phil Nicoletti – In order of infractions

• Chapter 5 Section A #12 – Riding at any time in such a manner as to endanger the life or limb of other riders, officials or the public

o Resulting in a 5-position penalty – applying Chapter 5 Section B #1 – B

• Chapter 5 Section A #11 – Riding at any time against the normal direction of travel on the track

o Resulting in a 5-position penalty – applying Chapter 5 Section B #1 – B

• Chapter 5 Section A #5 – An attack (physical or verbal) or threat on a participant/ rider

o Resulting in an Event disqualification – total loss of points and prize money for the Event 

o Resulting in Probation for the reminder of the entire 2019 Triple Crown Series. 

 #800 Mike Alessi – In order of infractions

• Chapter 2 Section C #4 E – Once gate selection has commenced, only riders and their mechanic who have been called may be in the starting gate area. Anyone found to be in the area before being could lose a gate selection

o Resulting in Probation for the remainder of the MX Tour – Triple Crown Series o Disregard for this rule while on probation will result in a 5 gate pick selection penalty

• Chapter 5 General Offences – conduct detrimental to the race, unsportsmanlike behavior

o Resulting in a FINE of $250.00 CDN

• Chapter 5 Section A #11 – Riding at any time against the normal direction of travel on the track

o Resulting in a 5-position penalty – applying Chapter 5 Section B #1 – B

• Chapter 2 Section C #4 E – Once gate selection has commenced, only riders and their mechanic who have been called may be in the starting gate area. Anyone found to be in the area before being could lose a gate selection *Note it is acceptable for a team manager to be in staging and at the start of gate selection when their rider is called upon

• Chapter 5 Section A # 5 – This includes any person who attacks or is involved in a confrontation anywhere on the premises prior to, during, or after an MRC sanctioned race

 o Resulting in Probation for the reminder of the 2019 Triple Crown Series 

o Disregard for this probation may result in FINES, and potential removal from event depending on the severity of any new confrontations.

The informed individuals will be allowed up to 72 hours from the time of this decision to appeal as outlined to these individuals.
